Personal Injury Attorneys Must Be Wary Of Taking On Fire Claim Cases

As personal injury attorneys, we instinctively look for "how can we help". The Southern California wildfires have naturally brought out the consumer advocate in many personal injury attorneys across the state.

There is that urgency on the part of many attorneys to help people who are without homes and figuratively lost as to the next step they need to take in terms of assessing their losses and filing claims.

But Richard Alexander, a very accomplished and knowledgeable personal injury attorney from San Jose, is quick to point out the dangers of this natural reaction of wanting to "go to the rescue" of the wildfire victims. Many personal injury attorneys, he says, don't have the knowledge or experience, he says, to even begin figuring out what they are getting into.

Alexander says there are many things attorneys need to understand before taking these cases pro bono or for free. First of all, he says, consider the expenses involved for the lawyer getting to the affected areas and taking time away from his other clients. Alexander is right. This is not a job you do over the telephone. You have to be physically present at the site of the disaster.

Alexander gives the example of a fire case where he successfully prosecuted against the State of California. On behalf of his client, Alexander alleged that the fire on Route 17 in Santa Clara County burned uphill and destroyed a family's entire automobile racing product business because the weeds and bushes there had not been cleared. That case settled in the plaintiff's favor 10 days before trial.

But then again, Alexander says it never is easy. Assembling the evidence is more than half the battle. An attorney needs to be prepared to sift through the charred remains looking for every piece of metal and traces of objects that were destroyed in the blaze. Alexander drew from his own personal experience when his home burned. The first step, he says, is to start creating the inventory, which is a lengthy and arduous process. It could be even more difficult for an attorney who hasn't done it before.

Here's his main advice on the matter: "If you don't have experience and clearly do not know how much work it is to process a property damage claim, the last thing anyone should do is take on a fire damage case on a pro bono basis. You are looking at a major tar baby. Don't doubt that for a minute."

Still, Alexander offers some tips for homeowners:
- Rent a house quickly before the market dries up
- Inform insurance and mortgage companies about the loss
- Obtain a copy of the policy and understand the terms of coverage
- Sift through the rubble to identify what burned and take lots of photographs

Another challenge for personal injury attorneys will be to find a contractor, Alexander says. Many, especially during these times when demand is extremely high, will make hay while the sun shines. They'll charge outrageous rates. Many may not even be local, but guys from out of state, who'll come here to meet the increasing demand.

Negotiating a contract takes a good understanding of the insurance policy and could be a touchy challenge if the personal injury attorney is not well-versed with how to do it. Alexander says most personal injury attorneys don't have the depth of knowledge or experience to do it. Some think they know, but in reality, don't know, he says. Attorneys will also be well advised to consult their malpractice insurance carrier before taking on cases that are outside their areas of experience or expertise.

The best bet is to hire a licensed claims adjuster who can do everything in one shot - from managing the claim, finalizing a building contract and writing an inventory. They usually charge 10 percent of the claim that's collected. But Alexander says they are worth every penny you pay them. Why? Because this is what they do for a living. They are experts. They have the experience it takes and know what they're doing, which is vital in these situations.

Alexander also looks at the flip side of the coin, which is not very pleasant. He says these people who lost their homes lived in homes that are not designed to do well in a fire. They chose to live in these high-risk areas and hillsides with vegetation that has the propensity to burn when the Santa Ana winds start gusting in the fall. Insurance companies, he says, will also look at what homeowners did to correct the flow of air around the house to minimize burning potential and whether they cleared brush and weeds around their homes.

Given all these considerations, Alexander advises attorneys not to be in a rush to take on fire loss claims unless they have some serious experience with fire claims and homeowners insurance coverage issues. Alexander says he won't take them on even with the knowledge or experience because of the hassles involved.

But, he says, public education is the key. And attorneys should leave that role to the State Bar of California or the Los Angeles, Orange and San Diego county bars. They have the funding and the resources to host public meetings and put out information to the public on how to hire the right adjuster, attorney and contractor for the respective jobs.

Says Alexander: "In my experience, most personal injury lawyers are way over their head in providing the quality of service, knowledge and experience these plaintiffs will need."

Homeowners should be wary of any attorney, adjusting service or contractor that solicits their business in this chaotic time.

Attorneys are not allowed by bar association rules to directly solicit homeowners in person either themselves or through an employee or agent. They are allowed to send you advertisements for their services however.

There is also a great emphasis on the physical fitness of the youngster so that they don't turn out to be another bookworm.

Lastly, with such a structured environment in place, it greatly helps under-motivated, disturbed and defiant youth to seek the purpose of their life. When at last such students compete in the world with other students, they tend to stand out and defy all odds and surprise their competitors with their talent, structured approach to problems and greater sense of responsibility.

Exposure And Violence Affect At-Risk Youth

Exposure to community violence has an affect on academic and health outcomes for At-Risk Youths.  I will provide the reader with proof, using documented studies and personal references, of the academic and /or health risks, due to violence that perpetuates environmental and physiological factors that attribute to youth development.

According to the (U.S. Census Bureau, 2003), youths in the U.S. represent 26% of the population and account for 50% of victims of violent acts.  A census study was composed of 13-18 year olds asked to share personal stories about their experiences with violence. College-aged youths show 93-100% to have witnessed violence at some point in their lives, (Gorman Smith and Henry Tolan, 2004).  Research shows that regular exposure to violence is associated with psychological difficulties, language and development skills associated with poor education and juvenile justice problems. Exposure of community violence is also a factor surrounding family problems, drug abuse, alcohol abuse, suicide attempts, economic pressure, drop -out rates and gang activity. According to (The U.S. Department of Education, 1997) and (Dodge, Pettit, Bates, 1997; Kendall-Tackett, Williams & Finkelhor, 1993), exposure to community violence is twice more likely amongst African Americans than any other race.

Several organizations are in place to reduce the effects of exposure to violence and health concerns; they include Human Services, U.S. Department of Education, and Community Development Agencies and the U.S. Department of Health and Human Services. There is a definite urgency because of the social indicators, such as education, income and employment status that are determined to be more indicative of child abuse and neglect than race or ethnicity. There are also health related issues associate with HIV and victims of child abuse and neglect.

Although I believe that exposure to violence affects our youth, another argument could be that there are some personal strengths and positive attributes. In referencing youths who have experienced such violence by way of physical and mental health risks, careful thinking and planning, leadership, determination and perseverance are some of the evident qualities. One need only ask the question, “Can violence occur in the community and the youth not be exposed to it?”  Although this is not normally the case, there are experiences of structured home environments where the youths cannot associate, outside of school activities.  I witnessed, in my urban neighborhood, a schoolteacher who chose to isolate her son from the other children around him; she did this by sending him clear across town to a private school and allowed him to socialize with only those individuals that attended that same school.  He lived in the midst of a violent community but had no association.  He is a very successful lawyer today.  Another question would be, “Can a youth develop a positive self-appointed role within a dysfunctional environment where relationships and events may occur?” Many youths who are classified as victims rather than indentified as being in need of services, may be a more positive aspect of exposure to violence in a given community. I had a friend once that took on the role of the parent to her younger siblings because her mother was on drugs and never in the home.  She cooked for her younger sisters and brothers and made sure they were in school, each day, on time.  She developed an optimal sense of identity and well being in order to keep her family together.

There are several recommendations for addressing the effects of family and community.  According to a journal written by Dexter R. Voisin of the University of Chicago entitled: (The Effects of family and Community Violence Exposure Among Youth: Recommendations For Practice and Policy), those recommendations are to Increase Public Awareness, Improve Detection and Intervention, Increase Provision of Evidence-Based Intervention, Youth Exposure to Violence, Locate Mental Health Service and Enhance Coordination Services and Collaborations.

There is a passage taken from (Teaching Social Skills to Youth) by Tom Dowd, M.A., and Jeff Tierney, M. Ed. that sums up my issue. “As human beings we live in social groups.  We learn that there are consequences that are both positive and negative that are attached to how we interact with others and how we choose to respond in social situations. The lessons learned at each stage in child development should become tools used to meet the demands of subsequent stages of life but somehow are not”

In closing, although there are many contributing factors in the exposure and violence that affect At-Risk-Youth, the negative factors largely out weigh the positive. We must continue to study and develop ideas and create programs to rid ourselves of the many problematic events that promote and continue to add to the exposure and violence that affect our youth.

There should be many approaches to underage drinking. First, there should be supervision of positive adult role models, youth leadership, and intensive programs. Also, since many teens get alcohol at home, some family strategies should be an improvement of parent-child relations: using positive reinforcement, listening and communication skills and problem solving. There should be consistent discipline and rulemaking such as setting an earlier curfew, statistics show that Orange County has a curfew on teens for 11:00pm- 6:00am, and limiting social time. During adolescence there should be a monitoring of children activities, like having a parent or guardian knowing where their child is going, what they are doing and who are they with. With these improvements there may be fewer teens drinking.

There are many possible approaches to curtailing underage drinking. First, teens can be influenced by positive adult role models, youth leaders, and community programs.

Many teens get alcohol at home, so parent education is a key to addressing this problem. Parents can be taught to better communicate with their children about alcohol use and can also model responsible behavior in their own alcohol use.

When parents exercise consistent discipline and rulemaking, such requiring their teens to observe curfew laws, alcohol use can be reduced. For instance, Orange County (California or Florida?) has a curfew on teens from 11:00pm- 6:00am; this limits the duration of unsupervised social activities.. Parents and guardians have a responsibility to know where their children are going, what they are doing and who are they with. When parents are aware of their children's activities and know their friends, they are much more likely to become aware of underage drinking and will be able to intervene appropriately.

If you are thinking of organising a management training programme for company, here’s what you can do.

Start with a specific goal in mind. What is the outcome of the entire exercise? Do you want your subordinates to work better as a team? Or do you want them to become better decision makers and leaders? A specific outcome will help you with the rest of the decisions that need to be made.

The next you have to decide is who is the training aimed at? Upper, mid or lower level management and whether is it a compulsory participation or not. If you are inviting speakers to come and address the employees make sure you send out their invitations months in advance so they can RSVP. So if they can’t make it you have enough time to find another speaker. If you are organising a team building programme include games and a lot of activities that include open communication and mingling. If it’s a leadership development programme call motivational and other inspirational people to take about their real life experiences and small lessons learnt along the way.

swimsuits: scar on stomach?

I have an extremely huge scar/rash/cuts on my stomach from just under my belly buttom down to my underwear line and it is wide as the length.
It started as a rash from an allergic reaction from the metal button of my jeans.
But I kept scratching it and it's become this big.
This summer I am doing a leadership training program with a bunch of my friends.
